Weinstein’s representative To Engelmayer tells TMZ that she chatted with her client twice today and he is overjoyed with the news of Thursday’s appeals court ruling … which found his constitutional rights were violated during the trial in 2020.
However, Judah says the disgraced movie mogul, currently incarcerated in an upstate New York prison, is only cautiously optimistic about the court’s decision and knows he has a difficult road ahead, especially as it remains to be seen whether and when he will be prosecuted again.
But she stresses that the news removed a significant hurdle for Weinstein and brought him to tears because he assumed no judge would dare challenge the court of public opinion by overturning his conviction.

As for the Manhattan District Attorney’s Office, which has assured TMZ that it will make every effort to retry the case, Juda says Weinstein has received no response and remains fixated on the appeals court’s decision and his newfound hope .
Weinstein hired criminal defense attorney Jennifer Bonjean to appeal his 2022 conviction in LA on three charges, including rape and forced oral copulation.
She tells us that the decision to overturn his conviction in New York comes as no surprise to her as she believes Weinstein did not receive a fair trial in the Big Apple, as she believes the jury was saddled with several unindicted allegations from his case overwhelmed in LA.

Bonjean tells us that if it were up to her, her client would be immediately released on bail pending an appeal. She also explained why she believes his conviction in LA needs to be overturned now… based on the outcome of his appeal in New York.
As you know, Weinstein was sentenced to 16 years in prison in the LA case and 23 years in prison in New York.
With his East Coast conviction now overturned, the latter sentence is off the table… and it remains to be seen what happens in Los Angeles – but for now, Weinstein is celebrating.
