Why is Prime Being Sued? Logan Paul Responds to Allegations | Entrepreneur

WWE wrestler and Prime Hydration co-founder Logan Paul is in the middle of two class action lawsuits alleging (separately) that Prime Hydration energy drinks contain more caffeine than advertised and that the drinks contain PFAS, also known as “forever chemicals.” .

This week, Paul responded to the allegations on TikTok The lawsuits are based on “zero evidence.”

Why is Prime being sued?

A lawsuit filed April 8 in New York accused Paul and Prime Hydration LLC co-founder KSI of “deceptive and deceptive practices” after tests commissioned by the plaintiff’s attorneys revealed that the 12-ounce Cans of energy drinks contain between 215 and 225 milligrams of caffeine, instead of the advertised 200 milligrams.

The lawsuit states that the plaintiff purchased several of the blue raspberry-flavored Prime drinks in August 2022 and that she would never have done so if she had known the true caffeine content. She’s asking for $5 million from Prime.

A separate lawsuit filed in California in August 2023 accuses Prime of containing PFAS, which are synthetic chemicals used in cleaning products, toiletries and stain-repellent sprays and are not approved for consumption by the FDA are.

According to the lawsuit, third-party testing determined that Prime’s grape flavor contains these chemicals. The plaintiff is seeking $5 million.

How did Paul and Prime react?

In a TikTok video posted to Paul’s account late Wednesday, which has since amassed over 15.3 million views, the influencer denied the allegations and denied that any Prime products contained chemicals or substances not approved by the FDA were permitted.

Paul clarified in the clip that the PFAS mentioned in the lawsuit refers to the bottle Prime is packaged in, not the actual liquid itself.

“This is not a crazy operation,” Paul said. “We utilize the leading bottle manufacturers in the United States. All your favorite beverage brands…they use these companies. If the product is served in plastic, they make a bottle for them.”

He then doubled down on his statement, calling the lawsuit “absolute nonsense” and claiming that third-party testing was invalid.

“They claim that Prime has 0.06 (parts per trillion),” Paul said of the tests. “But this is interesting because the EPA says that levels below 1.1 (parts per trillion) cannot be considered reasonably accurate. They don’t have the right tools or resources to even prove what they claim.”
