Uttarakhand High Court stays order of giving reservation to the domicile women of the state

The Uttarakhand High Court has put a stay on the order of giving 30 percent reservation to the domicile women of the state. On Wednesday, the court gave this decision while hearing the petitions filed against the reservation in the Uttarakhand Public Service Commission examination.

A division bench of Chief Justice Justice Vipin Sanghi and Justice RC Khulbe allowed the petitioners to appear in the examination. The government and the Public Service Commission have been asked to present their side by October 7. Women candidates of Haryana and Uttar Pradesh had filed a petition in the Nainital High Court opposing the reservation for women of Uttarakhand origin.

They said that the State Public Service Commission has given 30 percent reservation to the native women in the unreserved category in the Uttarakhand Combined Civil Subordinate Services Examination for the posts of Deputy Collector and other posts. Due to this they have been out of the examination of the commission.

Ban on the mandate of 2006

The petitioners told the government’s mandate of 2006 to give reservation against Articles 14, 16, 19 and 21 of the Constitution. The court was told that no state government can give reservation on the basis of birth and permanent residence. In the petition, there was a demand for cancellation of this reservation. After the hearing, the court, while staying the mandate of reservation, asked the government and the Public Service Commission to present their side.
